Enos Stoddard is charged with “breaking and entering” on Jamaica Pond.

Stoddard, the owner of an icehouse on the pond, is charged by the Town of West Roxbury with taking municipal property (8,000 tons of water in the form of ice) and selling it. The court finds in Stoddard’s favor, deciding that Colonial laws allowing citizens the right to “fish and fowl” in great ponds includes the right to harvest ice.
